Thomas WEATHERFORD to Claiborne HALL, 9 acres.
NOTE:
This is interesting. I’m am unsure of
the relationship here to Elisha WEATHERFORD who is buried on Hall’s Hill at his
death in 1806. This Elisha WEATHERFORD
appears to have come from Abbeville County, South Carolina to Smith Co.
TN. There is an Elisha WEATHERFORD in
Cumberland Co. VA in 1790 but I am unsure if this is same individual. I have wondered if there is relationship to
Claiborne HALL. Matilda S.
WEATHERFORD, wife of Thomas WEATHERFORD, was daughter of John BAKER (Smith Co.
TN Deed Book T, pages 242 – 244). The
WEATHERFORDs are found in 1850 census of
Lincoln Co. MO. Matilda is there as a
widow in 1860.

Claiborne
HALL subpoenaed as defendant in case brought by his
grandchildren
(Archibald B. BOSTON, Rebecca E. PAYNE, and
Betsy
Jane PAYNE and their husbands), against him.
Claiborne HALL
was
security for bond of Allen PIPER (his son-in-law) as guardian to
the
BOSTON children as minors of John BOSTON, deceased. John
BOSTON
was married to Roxey HALL (Claiborne’s daughter). They
both
died, leaving the children orphans who were raised by Claiborne
HALL.
7 Dec. 1874 J. H.
NICKSON appeared in open court and applied for letters of
administration
upon the estate of Claiborne HALL, decd.
He was granted administration with $300 bond with E. W. TURNER and W. W.
FERGUSON as his securities.

Claiborne HALL died intestate in Smith County on – day of – 1874,
leaving
no widow and the complainants and defendants are all
(except
J. H. NICKSON) the only surviving heirs, and distributees, of
said
deceased.
NOTE:
On page 23, the non-residents heirs were listed as Mary
ETHERIDGE,
Susan HALL, Martha BOSTON, Archabald HALL, J. B.
GREGORY
and his wife Eliza GREGORY, Emely Jane CANIDAY.
Arthula
E. PAYNE was an infant resident of Sumner County - J. H.
NICKSON
was appointed her guardian. The resident
heirs were

C. PERKINS and wife Sally PERKINS, Allen PIPER and wife
Rebecca
D. PIPER, Archibald BOSTON, Rebecca E. PAYNE.

1/2 poles to a Rock; thence South 48 “ west 34 poles; thence South 12” West 19
½ poles to a stake, thence south 19” East 22 poles to an oak Samuel HIGH’s old
corner, thence east 9 ½ poles to a stake; thence south 65 East 14 poles to a
stake; thence south 80” East 16 poles to a stake; thence south 86 ½” East 20 poles
to a stake; thence North 85” East 15 poles to a stake; thence North 21” East 16
poles to a stake; thence North 32 “ East 26 poles to a stake: thence North 45”
East to the beginning, containing by survey 44 acres, 2 roods & 6 poles of

The
land was sold to S. M. PHELPS, the purchaser, at auction on the courthouse
steps on 20 March 1875. He paid
$430. There is a sketch
of
the land in the record. (I have send if
desired).
The estate records of Claiborne HALL are in the original
format at the Smith County Archives in Carthage, Tennessee. Copies at FHL in Salt Lake City. These contain a receipt from Dr. J. C. COSBY
for visits to his bedside. The last
entry was dated 15 November 1874. I suspect that or the following day was the date of his death.
